EL INTERNAMIENTO NO VOLUNTARIO POR RAZÓN DE TRASTORNO PSÍQUICO. COMENTARIOS AL ART. 763 L.E.C.

Resumen

En la presente ponencia, se expone y discute de forma pormenorizada el vigente Art. 763 L.E.C. que, al igual que el anterior art. 211 Código Civil, sigue contemplando dos supuestos claramente diferenciados, a saber, el ordinario, que requerirá autorización previa del Juez competente, y el urgente que será directamente decidido por el profesional sanitario que dictamine sobre su necesidad y urgencia y posteriormente ratificado por la autoridad judicial. La ponente, subraya la necesidad de colaboración entre todos los llamados a intervenir en este tipo de actuaciones recordando las funciones de los Jueces en esta materia no son sino la de meros garantes de derechos y libertades de los ciudadanos y, en modo alguno, la de obstaculizar el libre ejercicio de las atribuciones de los médicos dentro del marco de legalidad vigente.

Abstract

In this paper, the current Article 763 L.E.C. is explained and discussed in detail. As with the former Article 211 of the Civil Code, it still contemplates two clearly differentiated cases, that is, the ordinary one, which would require prior authorization by the competent Judge, and the urgent one, which would be directly decided by the health professional who determines its necessity and urgency, and which is subsequently ratified by the judicial authority. The paper underlines the need for collaboration among all those called on to intervene in this type of actions and reminds the public that the Judges’ functions in this material are no more than mere guarantors of citizens’ rights and liberty, and their function should not be that of hindering the free exercise of the doctors’ attributions within the framework of the legality in use.
